dc.description.abstract | This research investigates the legal and philosophical aspects pertaining to the offence of 'carnal knowledge against the order of nature' in the context of Zambia. The objective of this research is to provide a thorough examination of the legal framework that governs this particular offence in the Zambian legal system. This analysis will encompass the historical development, statutory basis, and current interpretations of the offence. Furthermore, this research examines the philosophical foundations that shape the understanding of the 'order of nature' in the socio-cultural milieu of Zambia. This study employs an interdisciplinary methodology, integrating legal analysis and philosophical inquiry in order to elucidate the intricacies linked to the offence. The analysis involves a thorough examination of pertinent statutes, case law, and legal commentary in order to identify the developing patterns in judicial interpretation pertaining to this particular offence. In addition, this study examines the socio-cultural and philosophical viewpoints that influence the conceptualization of 'carnal knowledge against the order of nature'. It also assesses the consequences of these conceptualizations on personal freedoms and human rights. Through a critical analysis of the legal and philosophical aspects of this offence, the research makes a valuable contribution to the continuing scholarly discussion surrounding the convergence of law, culture, and morality. The results of this study have the potential to provide valuable insights for legal professionals, politicians, and academics regarding the consequences of the existing legal structure and its compatibility with modern human rights norms. Furthermore, the primary objective of this study is to foster more extensive deliberations regarding the function of law in mirroring and influencing society norms, specifically in relation to sexual behavior and personal freedom. | en_US |
